Welcome to Promptank (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our AI-powered content generation platform, including any associated websites, applications, widgets, and services (collectively, the “Service”).

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. About Our Service

Promptank is an AI-powered platform that enables users to generate text and images using artificial intelligence. Our Service connects to third-party AI providers to process your requests and deliver AI-generated content.

What we do:

  • Provide an interface for AI text generation
  • Provide an interface for AI image generation
  • Offer embeddable widgets for websites
  • Manage a credit system for service usage

What we do NOT do:

  • Store your input prompts or conversations
  • Store AI-generated outputs
  • Train AI models on your data
  • Sell or share your content with third parties

2. Eligibility

To use our Service, you must:

  • Be at least 18 years old, OR have parental/guardian consent if between 13-17 years old
  • Have the legal capacity to enter into binding agreements
  • Not be prohibited from using the Service under applicable laws

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account Registration

3.1 Guest Access

  • You may use limited features without creating an account
  • Guest users receive a daily allocation of free credits (reset at midnight UTC)
  • Guest usage is associated with your device/browser

3.2 Registered Accounts

  • Some features require account registration
  • You must provide accurate information (email address)
  • You are responsible for maintaining account security
  • You must notify us immediately of any unauthorized access

3.3 Account Termination

  • You may delete your account at any time just contant use in case of assistance
  • We may suspend or terminate accounts that violate these Terms
  • Upon termination, unused credits are forfeited and non-refundable

4. Credit System

4.1 How Credits Work

  • Credits are required to use AI generation features
  • Different operations cost different amounts of credits:
  • Text generation: As configured per endpoint
  • Image generation: As configured per endpoint
  • Multimodal (text + files): As configured per endpoint
  • Credits are deducted upon successful generation

4.2 Free Credits

  • Guest users receive daily free credits
  • Registered users may receive monthly free credits based on their plan
  • Free credits reset according to the applicable period and do not roll over

4.3 Purchased Credits

  • Additional credits are purchased directly from Gumroad (external website)
  • We do not process or handle any payments – all transactions occur on Gumroad’s platform
  • After purchase, you receive a license key from Gumroad
  • Enter your license key on our platform to verify and receive credits
  • All purchases are subject to Gumroad’s refund policy
  • Purchased credits do not expire while your account remains active
  • Credits are non-transferable between accounts

4.4 Credit Modifications

  • We reserve the right to modify credit pricing and costs at any time
  • Changes will not affect already-purchased credits

5. Acceptable Use

5.1 You MAY use the Service to:

  • Generate text and images for personal use
  • Generate text and images for commercial use
  • Embed widgets on websites you own or control
  • Use AI outputs in your projects, products, or services

5.2 You MAY NOT use the Service to:

  • Generate illegal content under any applicable jurisdiction
  • Create content that promotes violence, hatred, or discrimination
  • Generate child exploitation material (zero tolerance)
  • Create content intended to harass, threaten, or harm others
  • Produce misleading content (deepfakes) without disclosure
  • Infringe on copyrights, trademarks, or intellectual property rights
  • Bypass rate limits or security measures
  • Resell access to the Service without authorization
  • Use automated systems to abuse the Service
  • Violate the terms of underlying AI providers

5.3 Consequences of Violation

  • Immediate account suspension or termination
  • Forfeiture of credits without refund
  • Reporting to law enforcement if required
  • Legal action to recover damages

6. Ownership and Intellectual Property

6.1 Your Content

  • You own your inputs: Your prompts and uploaded files remain yours
  • You own your outputs: AI-generated content belongs to you
  • Commercial use permitted: You may use outputs commercially, subject to:
  • Compliance with local laws and regulations
  • Compliance with third-party AI provider terms
  • Your responsibility to verify content accuracy

6.2 Our Content

  • The Promptank platform, branding, and interface are our property
  • You may not copy, modify, or redistribute our software
  • Widget embedding is permitted only as provided through our Service

6.3 Third-Party AI Providers

  • Our Service uses third-party AI providers (including but not limited to OpenRouter, Poe, and Nebius)
  • AI-generated outputs may be subject to the terms of these providers
  • Some providers may have restrictions on commercial use of specific models
  • It is your responsibility to ensure compliance with applicable provider terms

6.4 No Storage Guarantee

  • We do NOT store your prompts, inputs, or outputs
  • Once generated, you are responsible for saving content you wish to keep
  • We cannot recover lost or unsaved content

7. File Uploads

7.1 Supported Files

  • Images (JPG, PNG, GIF, WebP, etc.)
  • Audio files
  • Video files
  • PDF documents

7.2 File Requirements

  • Maximum file sizes are enforced per feature
  • Files are transmitted to AI providers for processing
  • Files are NOT permanently stored on our servers

7.3 Your Responsibilities

  • You must have legal rights to upload any file
  • You must not upload malware, viruses, or harmful code
  • You must not upload illegal content
  • Uploaded content must comply with our Acceptable Use policy

8. Third-Party Services

8.1 AI Providers

Our Service relies on third-party AI providers for content generation. These include:

  • OpenRouter
  • Poe
  • Nebius AI Studio
  • Other providers as we may add

We are not responsible for:

  • The availability of third-party services
  • The quality or accuracy of AI outputs
  • Changes to third-party pricing or terms
  • Content generated by AI models

8.2 Payment Providers

Payments are processed by third-party providers (e.g., Gumroad). By making a purchase, you also agree to their terms of service.

9. Disclaimers

9.1 Service Provided “As Is”

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

9.2 AI Content Disclaimer

  • AI-generated content may be inaccurate, incomplete, or biased
  • AI may produce unexpected, offensive, or inappropriate outputs
  • AI outputs should NOT be used for medical, legal, financial, or professional advice
  • You are solely responsible for reviewing and verifying all AI outputs
  • We do not endorse or verify the accuracy of AI-generated content

9.3 No Guarantee

We do not guarantee:

  • Uninterrupted or error-free service
  • Specific results from AI generation
  • Compatibility with all devices or browsers
  • That the Service will meet your specific needs

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • We are not liable for loss of profits, data, or business opportunities
  • We are not liable for any decisions or actions taken based on AI-generated content
  • Our total liability shall not exceed the amount you paid us in the last 12 months

11. Indemnification

You agree to indemnify, defend, and hold harmless Promptank and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you create using the Service

12. Changes to Terms

  • We may modify these Terms at any time
  • Material changes will be communicated via email or platform notification
  • Continued use after changes constitutes acceptance
  • If you disagree with changes, you must stop using the Service

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. We will attempt to resolve disputes amicably before pursuing legal remedies.

For users in the European Union, nothing in these Terms affects your statutory consumer rights under applicable EU law.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
